According to Massachusetts General Law Chapter 37, Section 11 &12, the High Sheriff of the County is mandated to serve civil process. MGL Ch.37, Section 3 empowers the Sheriff to appoint Deputy Sheriffs to perform official acts of process. Appointed Deputy Sheriffs are trained through the Massachusetts Intermittent Police Training Council to properly deliver important court and non-court documents and are held to the same high standards as any law enforcement official.

The Franklin County Civil Process Division consists of seven Deputies, serving twenty-six towns and processing over 5,000 services annually. Civil Process is responsible for serving all process, both civil and criminal, issued by the courts, attorneys and individual plaintiffs. Services may include but are not limited to the following:

  • Summons & Complaints, Show Cause Notice, Supplementary Process of Judgment Debtor, Orders of Notice, Summons to Trustee, Capias Warrants

  • Divorce, Motions, Child Support/Custody, Modifications, Support, Separate Support, Paternity, Contempt Summons & Guardianships

  • Witness Subpoena's and Notice of Depositions

  • Real Estate Seizures & Levies, Writs of Execution, Repossession of Vehicles, Bulk Attachments & Sheriff's Sales

  • 14 Day Notice to Quit, 30 Day Notice to Quit, Summary Process Summons & Complaint, Execution on Judgment for Summary Process

  • Trespass Orders

Historically, Sheriffs have been empowered to enforce the judgments and orders of the courts. This often dangerous work involves evicting tenants, seizing property and arresting persons on warrants.

The Franklin County Civil Process Division offers confidentiality in regard to all parties involved, professionalism and competence. Communication with the courts, attorneys, and plaintiffs is critical to be certain all paperwork is completed and received in a timely manner.

Please contact the Civil Process Office for service fees, cash or checks are accepted for payment and payable to F.C.S.O.-Civil Process. Completing and forwarding the informational sheet, along with other pertinent materials will assist Deputies in serving process.
